In 2007, the Town of Evans announced a town-wide reassessment. Given the town’s penchant for taking care of family & friends, I began to wonder if there was a way to determine winners and losers. I concluded the best way to do this was to compare the 2007 assessments to the new 2008 assessments. To do this required a little custom programming and the assessment data for both years in Microsoft Excel format. I obtained the data for 2007 & 2008 and every year through 2019.

In 2020 through 2022, my Freedom of Information for the assessment data was denied. Mary Hosler, the town’s FOIL appeal officer, did not respond and/or denied my appeal.
My only option to get the data was to have a lawyer file an Article 78.
YOU SHOULD NOT HAVE TO GET A LAWYER TO “ENCOURAGE” EVANS OFFICIALS TO HONOR THEIR OATH OF OFFICE AND FOLLOW THE LAW.
The Judge ruled in the town’s favor. Using the town’s under-oath explanation for the denial, my lawyer rewrote the FOIL request and the 2022 assessment data was provided in Microsoft Excel Format on 3-22-2023. I lost the battle but won the war!

Last but not least: On the same day I received the 2022 assessment data from the Town Clerk, I also received a denial letter from Deputy Supervisor Tom George!
