I don’t know if it is ironic or just sad that the only thing an Evans elected official told me that is 100%, beyond a shadow of a doubt true is “All politicians lie“!
Mary Hosler routinely denies Freedom of Information requests. State law requires that a reason be given for a denial.
Since 2007, that’s 13 years, I have obtained the town’s assessment data in a Microsoft Excel readable data file. In 2020, Hosler declined to provide the requested data file. I post assessment data online as a resource for the town’s residents. [ Click Here ] My FOIL was denied on basis that the file format does not exist. I contacted NYS COOG which replied that if the town has the ability to create the file, it should be provided. I FOILed the assessment data from the Town of Hamburg. They provided the Excel File. [ Click Here To Download The Hamburg Assessment Data ] The state / county / towns all use the NYS ORPTS RPSV4 software. If one town can export data to an Excel file, all towns would have the same capability.
Not only does the Town of Evans have the capability to create the Excel file, New York State provides user training for the NYS ORPTS RPSV4 software that includes creating custom Excel files!
Based on the page https://www.tax.ny.gov/research/property/assess/training/schedule.htm the town’s explanation for the denial appears to be in conflict with the truth since the state provides training on how to create custom Excel files.
I’ve had to contact NYS COOG on several occasions in 2020 regarding denied FOILs. Their remedy is an Article 78. I do not feel it is right to have to take the town to court to ask a judge to require the town to follow the law.
This is just another reason to keep term limits!
